EFCA Fact Sheet

The deceptively named Employee Free Choice Act (EFCA) strips workers of their right to a government-supervised, private-ballot vote and replaces it with a forced-unionization system. This fact sheet offers data points on public opinion, special interest opinion, and myriad other measures being taken to prevent passage of EFCA.

Legislative Action Center

Use the NSBA’s Legislative Action Center to contact your members of Congress today! Watch for targeted action alerts to see if your Senators or Member of Congress is a potential target. Remember, the procedural vote in the Senate is the most critical vote. Urge your Senator to vote “no” on cloture.

How to talk to Employees about EFCA

EFCA will impact both employers and employees alike. Take the time to encourage your employees to fully educate themselves on the impact of EFCA. EFCA would strip away workers’ right to a secret ballot election when deciding whether their workplace will join a union. Employees should know what it means to be in a union, including the withholding of union dues, use of mandatory political contributions and solvency of pension plans in which they will be forced to enroll.
